5 Star Online Training (5 Star) requires that these terms and conditions of use must be accepted and agreed to by the student during setting up their account.

ACCEPTANCE OF TERMS.

Prior to enrolment it is our responsibility to ensure you know everything about your course including;

Fees, charges and refunds
The qualification or unit of competency
Appeals and complaints

Throughout the website where you purchased the course you have access to information regarding our online courses, if you’d like more information you can download the Student Guide or just give us a call on 1300 496 337. We’re here to help.

I agree that I am undertaking this training on my own without assistance from others and the answers that I give in any online assessments will by my own.

I understand my obligations and yours

I know how I’m going to learn

I know how I’m going to be assessed

I know how to appeal or complain (even though this will be unlikely)

DESCRIPTION OF SERVICES.

5 Star provides you with access to a variety of resources, materials, downloads and services, including software, communication forums, educational and support materials and product information (collectively “Services”). The Services, including any updates, enhancements, new features, and/or the addition of any new 5 Star product and service, are subject to the TOU.

PERSONAL AND NON-COMMERCIAL USE LIMITATION.

Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.

PRIVACY AND PROTECTION OF PERSONAL INFORMATION.

See the Privacy Statement on the 5 Star website for disclosures relating to the collection and use of your information.

GENERAL

You may be held legally responsible for the content you submit to Support Forums or any other 5 Star Services.

All material published on Support Forums or other 5 Star Services is at 5 Star’s sole discretion.

Your contribution may be edited, removed or not published if 5 Star considers it to be:

(a) defamatory, or otherwise unlawful or that it violates laws regarding harassment, discrimination, privacy or contempt;

(b) intentionally false or misleading;

(b) an infringement of intellectual property rights or copyright. See below for further information on copyright;

(d) of nuisance value, inappropriate, off-topic or vexatious;

(e) compromising the privacy of yourself, other contributors or of 5 Star Services, or containing inappropriate personal information;

(f) deliberate provocation of other community members;

5 Star reserves the right to archive and republish all contributions to its interactive features across all platforms.

Contributors should be aware that their posts may remain online indefinitely.

5 Star reserves the right to use contributions for internal training purposes.

Repeated breaches of these Terms of Use may cause 5 Star to suspend access and in very serious cases, initiate legal action.

COPYRIGHT

The right to “copy” always remains with the owner of the material. Unless expressly stated otherwise, you are not permitted to copy or republish anything you find on the internet without the copyright owner’s permission.

If you wish to refer to material on someone else’s website we recommend you include an attribution in your message.

Under Australian copyright law, limited quotation is permissible in the context of genuine review and criticism.

When you submit content, in any format, you acknowledge that you have all necessary rights, including copyright, in the material that you are contributing to 5 Star Services.

NOTICE SPECIFIC TO SOFTWARE AVAILABLE ON THIS WEBSITE.

Any software that is made available from the Services (“Software”) is the copyrighted work of 5 Star and/or its suppliers. Use of the Software is governed by the Software License Agreement on our website and the terms of the end user license agreement, if any, which accompanies or is included with the Software (“License Agreement”). An end user will be unable to access any Software that is accompanied by or includes a License Agreement unless he or she first agrees to the License Agreement terms.

The Software is made available via the hosted service for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED UNLESS SUCH REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PERMITTED BY THE LICENSE AGREEMENT ACCOMPANYING SUCH SOFTWARE.

THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, 5 Star HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SOFTWARE, INCLUDING ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

FOR YOUR CONVENIENCE, 5 Star MAY MAKE AVAILABLE AS PART OF THE SERVICES OR IN ITS SOFTWARE PRODUCTS, TOOLS AND UTILITIES FOR USE AND/OR DOWNLOAD. 5 Star DOES NOT MAKE ANY ASSURANCES WITH REGARD TO THE ACCURACY OF THE RESULTS OR OUTPUT THAT DERIVES FROM SUCH USE OF ANY SUCH TOOLS AND UTILITIES. PLEASE RESPECT THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS WHEN USING THE TOOLS AND UTILITIES MADE AVAILABLE ON THE SERVICES OR IN 5 Star SOFTWARE PRODUCTS.

MEMBER ACCOUNT, PASSWORD, AND SECURITY.

If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a username. You are entirely responsible for maintaining the confidentiality of your password and account. You may not use anyone else’s account at any time, without the permission of the account holder.

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any 5 Star server, or the network(s) connected to any 5 Star server, or interfere with any other party’s use and enjoyment of any Services.
